The Korea Customs Service has prepared a practical guideline on the criteria for not issuing amended import tax invoices under the Value-Added Tax Act, effective January 1, 2026.
- Cases where no invoice is issued: prosecution for customs evasion or a notified disposition, fraudulent underreporting, failure to submit taxation data on related-party transactions, repeated identical errors after notice of a customs audit, and similar cases
- In these cases, the additionally paid value-added tax cannot be deducted as input tax.
- The period for counting repeated errors is limited to the previous customs audit and similar reviews, and the criterion for serious defects in price declarations applies to price declarations made on or after January 1, 2026.
- The procedures for submitting opinions on a decision not to issue an invoice and for filing objections through a committee are also included.
